These Terms and Conditions for Sale and Delivery apply to all purchases made on montanafurniture.com and will always be available from this website.

2. Finalisation of agreement

2.1. The agreement between the Customer (hereinafter “you”) and Montana Furniture A/S (hereinafter “Montana”) is considered finalized once Montana has sent your order confirmation.

2.2. Once Montana has received your order, we will e-mail you an order confirmation as soon as possible with information about your order number, name and address, payment method, delivery address and an overview of the items you have ordered. Your order confirmation will not be available on the website and you are therefore encouraged to save the order confirmation as your receipt.

3. Prices and payment

3.1. All prices stated include 25% VAT. The applicable price is the price stated on the website next to the item in question at the time of ordering.

3.2. Montana reserves the right to amend any prices on its website which may be incorrect. Montana also reserves the right for spelling errors and typos, sold-out items, price changes and changes to fees and/or other costs stated on the website at any time.

3.3. The following payment methods can be used on the website: Visa, MasterCard,  GooglePay and ApplePay. A fee is charged for certain types of cards. Any fees will be displayed on the payment page.

3.4. When using a payment card for payment, the amount is only debited after your goods have been shipped.

3.5. Payment on the website is made via Reepay secure payment, a certified payment solution. The Reepay secure payment solution uses SSL encryption to communicate, just as SSL encryption is used to communicate between the customer and the server where Reepay is located. This means that all information transmitted via the internet in connection with payment is encrypted with a security certificate. It is therefore not possible for unauthorised persons to intercept information concerning the customer’s credit card. Read more about Reepay.

4. Delivery time and place of delivery

4.1. Shipments are delivered to a parcel shop or freight forwarder for home delivery, depending on the type of item and size. The shipping method will be indicated when you place your order on montanafurniture.com.

4.2. Montana usually confirms and ships orders within 5-10 business days of sending the order confirmation. This is a guide only and if your delivery will take longer, this delivery time will be indicated on your order confirmation. Please note that Montana closes for the summer holidays in weeks 29, 30 and 31, as well as for the Christmas holidays between Christmas and New Year. In both periods, delivery times will be longer than usual.

4.3. Montana cannot be held responsible for delivery delays. Products that are backordered may have a longer delivery time than specified. The customer will be notified in writing if their order is delayed.

4.4. Details of delivery time and place of delivery will be shown on your order confirmation.

4.6. We offer delivery by a freight forwarder. For this type of delivery, we charge a varying fee depending on the delivery type as well as the total order amount which is paid together with the order.

4.7. If the customer is not home at the agreed delivery time, a delivery fee will be charged for re-delivery. For shipments that are delivered to parcel shops, a return delivery fee of SEK 100 is charged. For shipments delivered with furniture transport, a return delivery fee of SEK 700 is charged.

5. Transport damages

5.1. Upon receipt of your order, you should examine it for transport damage and declare any damages if the packaging appears damaged.

5.2. If the packaging is badly damaged, you should refuse to take receipt of the delivery and note your reasons on the delivery slip. This makes it easier for you to prove that the damage occurred before you received your item.

5.3. If the packaging is badly damaged, and you have taken receipt of the delivery, please report the transport damage to us as soon as possible and within 7 days at [email protected].

5.4. You are advised to attach photo documentation and must always state the order number that appears on the order confirmation you received by e-mail when you made the purchase. Please also report the transport damage to the parcel shop which you received the delivery from or the shipping company that delivered it, as soon as possible.

6. Right of cancellation

6.1. You have the right to cancel a purchase made on our website (right of cancellation).

6.2. If you wish to exercise your right of cancellation, you must notify Montana within 30 days of receipt of your item by contacting [email protected]. If the last day for exercising your right of cancellation falls on a public holiday, a Saturday, Danish Constitution Day, 24 December or 31 December, the last day for cancelling your order is the following working day.

6.3. Once you have notified Montana that you wish to cancel your purchase, you must arrange shipping with Montana by e-mailing [email protected] within 30 days. You bear all costs involved in returning the item to Montana. Costs for returns are set at SEK 100 for parcels and SEK 700 for furniture. Return of the item is agreed with Montana customer service.

6.4. As a customer, the burden of proof that you have exercised your right of cancellation is in accordance with Section 6.2. and Section 6.4 lies with you.

6.5. Once you have notified Montana that you wish to exercise your right of cancellation, we will refund all amounts received from you, including delivery costs, without undue delay and no later than 14 days from the date on which we are made aware of your desire to cancel your purchase. However, Montana will not reimburse any additional costs if you chose a form of delivery other than the cheapest form of standard delivery that we offer. Any collection fees are non-refundable.

6.6. We will only make refunds provided that the item has been received by Montana or that you have provided documentation that the item has been returned.

6.7. Montana will process your refund using the same method of payment that you used for the original transaction unless you have expressly agreed that we may process the refund a different way. Costs for return shipping are borne by the customer and offset against the refund.

6.8. If you choose to cancel part of your order such that only a part of the purchase is returned, Montana will refund an amount equal to what is returned without undue delay and no later than 14 days from the date we become aware of your desire to cancel part of your purchase. Montana will not reimburse delivery costs in the event of part cancellation.

6.9. To the extent that the value of the item has deteriorated as a result of the item being handled beyond what was necessary to determine the condition of the item, its properties and the way it functions, an amount equal to this impairment will be deducted from the refund provided by Montana. For example, if the item has been used for suspension etc, and if the item bears signs of this, you still have a right of cancellation as described in Section 6.2. and Section 6.4., but you are liable for any deterioration in the value of the goods.

6.10. If you choose to return an item, it is important that the item is returned in its original packaging.

7. Complaints and defects

7.1. The rules on defects in the Danish Purchase Act (Købeloven) may apply to your purchased items.

7.2. At Montana Furniture A/S, we offer a 5 or 10-year warranty on our products. The warranty period is stated on the product page. You therefore cannot claim for faults and defects that appear later than 5 or 10 years after the delivery of the item. You can read more about our guarantees.

7.3. If you discover that there are defects in your delivery, please notify Montana within a reasonable time after these defects are discovered. If you fail to give notice within a reasonable time, you lose your right to claim the defect. Notice given within two months of the defect being discovered is considered timely.

7.4. You must inform Montana of the nature of the fault or defect in connection with making a return. Returns or complaints must be made to Montana Furniture A/S, Akkerupvej 16, 5683 Haarby.

7.5. If the product proves to be faulty or defective within the warranty period, Montana undertakes to remedy such faults and defects. If it turns out that it is not possible – or that Montana does not deem it appropriate – to repair the item, Montana instead undertakes to deliver a new defect-free item upon receipt of the defective item. If the item cannot be repaired or replaced, we will refund the purchase price instead. In the event of a complaint, Montana will assume any costs for return shipping. Return shipping must be agreed with [email protected] before the item is shipped.

7.6. Montana assumes no liability with respect to the customer other than what is set out above. Montana cannot be held liable for indirect losses or consequential damages under any circumstances.

8. How to appeal

8.1. For disputes that have arisen between you and Montana regarding your purchase, you can lodge a complaint with the Danish Competition and Consumer Authority’s Centre for Complaint Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg, tel. +45 72 40 56 00. You can find details on conditions for complaints, fees etc. at www.forbrug.dk. You can submit your complaint via the Nævnenes Hus' website.

8.2. For customers residing in another EU country, complaints regarding any disputes that have arisen between Montana and the customer regarding the customer’s purchases are submitted to the European Online Dispute Resolution Platform via their website. When lodging a complaint, the customer may provide Montana’s e-mail address [email protected].

9. Liability

9.1. Montana is not liable for delays or non-compliance due to force majeure. We are exempt from fulfilling our obligations for as long as force majeure persists.

9.2. Montana assumes product liability with respect to the customer in accordance with applicable Danish legislation.

9.3. Montana’s liability for damages is limited in all cases to an amount equal to the price of the item the customer has purchased.

10. Personal data

10.1. The information you provide in connection with your order will be registered with Montana who will then be the data controller responsible for the processing of your information. Read more about our processing of personal data and your rights in this connection in our Privacy Policy.
